Valid for the users of www.huvepharma.com interested in the Veterinary Medicinal Products (VMPs) of Huvepharma EOOD (“Huvepharma”) distributed and sold in the territory of the EU and classified as “Prescription only medicines – Veterinarian”

Please review the following terms carefully, because they represent a legal agreement between you and Huvepharma®. The terms shall be enforced, once you first access the Huvepharma website. You are not permitted to use the EU section of Huvepharma’s website unless and until you accept the present Terms of Use and our Privacy Policy.

Huvepharma respects your privacy. Please refer to our Privacy Policy, which explains how we process all data and information that pertain to your privacy. When you access or use Huvepharma’s website, you signify your agreement not only to these Terms of Use, but also to the Privacy Policy. That means that you have read all their content, understand it and agree to be bound by both documents.

1. Basic requirements

In order to access and use the EU section of Huvepharma’s website you have to be a medical specialist – qualified vet or pharmacist (hereinafter referred to as (“Qualified Person”).

2. Warning to users

Your account login may only be used by you – a single login shared by multiple people is not permitted. Each user is responsible for maintaining the security of his/her account login. You must notify us immediately of any breach of security or unauthorized use of your account. Huvepharma cannot and shall not be liable or responsible for any losses or damages from your failure to comply with this security obligation.

3. Acknowledgements and agreements

You hereby acknowledge that the information displayed on Huvepharma’s website is provided over the internet and mobile networks and so its quality and availability may be affected by factors outside Huvepharma’s reasonable control. By using Huvepharma’s website, you also acknowledge and agree that Huvepharma is not responsible for examining and evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of any third party’s materials that may be displayed on Huvepharma’s website.

You hereby agree: (i) not to provide false or inaccurate information: (ii) not to use another user’s account; (iii) to use the information displayed on Huvepharma’s website at your sole risk; and (iv) in no case to use that information for any unlawful purpose or for the promotion of illegal activities.

To the maximum extent permitted by the law, the information displayed on Huvepharma’s website is provided “as is” and “as available” and without warranty of any kind, and Huvepharma hereby disclaims any and all warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment, and non-infringement of third party rights. 5. Ip rights

All trademarks, copyright, database rights, logos and trade names and any other intellectual property rights of any nature which appears on Huvepharma’s website together with the underlying software code are owned either by Huvepharma or by its affiliated companies, or by its licensors, or by any other third company where so indicated. You may not reproduce, download or otherwise use such trademarks, copyright, database rights, logos and trade names or any other intellectual property rights without prior written consent of the appropriate owner thereof. We claim no intellectual property rights over the data and information you provide to us.

6. Limitation of liability

To the extent not prohibited by the law, in no events shall Huvepharma (its affiliated companies, directors, employees, licensors, or partners) be liable for personal injury, or any incidental, special, direct, indirect, punitive, exemplary or consequential damages whatsoever, including but not limited to damages for loss of profits, loss of data, business interruption or any other commercial damages of losses, arising out of or related to your use or inability to use Huvepharma’s website, however caused, regardless of the theory of liability (contact, tort, including negligence, product liability or otherwise), unauthorized access to or alteration of data, or any other matter relating to Huvepharma’s website, even if Huvepharma has been advised of the possibility of such damages.

You agree to defend, indemnify and hold harmless Huvepharma, its affiliated companies, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to attorney’s fees) arising from: (i) your violation of any term of these Terms of Use; (ii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iii) your activities in connection with Huvepharma’s website.

8. Termination

Your rights under the Terms of Use shall be automatically terminated without any notice by Huvepharma, if you fail to comply with any of the terms and conditions provided herein. Upon termination of the present Terms of Use, you must cease any and all use of Huvepharma’s website and must destroy all materials obtained from this website and all copies of it. The provisions of this Terms of Use concerning Warranty Disclaimer, Trademarks, Limitation of Liability, Indemnity, Governing law and Competent Court shall survive any termination of this Terms of Use.

9. Modifications

Huvepharma reserves the right to amend these Terms of Use at any time without notice and will update these Terms of Use in the event of any such amendments. In addition, Huvepharma reserves the right at any time and from time to time to amend or withdraw all information from its website (or any part thereof), temporarily or permanently, for any reason, with or without notice. It is your sole responsibility to check these Terms of Use and the other updates on a regular basis to view any such changes. If you continue to use Huvepharma’s website, you signify your agreement to our revisions/amendments and supplement to these Terms of Use.

10. Governing law and competent court

These Terms of Use are governed by and are to be construed in accordance with the laws of the Republic of Bulgaria. All disputes arising from these Terms of Use or related to them, including those arising from or concerning their interpretation, invalidity performance or termination, as well as the disputes for filling gaps in these Terms of Use or their adaptation to newly established facts, shall be referred for resolution to the Court of Arbitration at the Bulgarian Chamber of Commerce and Industry in compliance with its Rules for Litigations, based on arbitration agreements, and Rules on expedient procedure in arbitration cases.

Please note that Huvepharma’s VMPs may have different labelling packaging appearance depending on the country. Should you use Huvepharma’s website or its content, please note that it is your responsibility to comply with the applicable local legislation.
